It is also possible, says specialist lawyer Alexander Bredereck from Berlin. The expert in labor law stresses, however, that employees do not lose their right to vacation as a result. Employers should pay particular attention to this.
In purely theoretical terms, an employee can ask to take his vacation even if he had previously received it from the employer. Typically, however, hardly anyone will go to court because of it. “If no one complains, it’s possible and just as common during the current working relationship,” Bredereck sums up.
If, on the other hand, an employment relationship ends, things are a little different. Those who can no longer take their vacation receive money for it. “In this case, the employer is even obliged to pay for the vacation”, specifies the specialist lawyer.
